3. Definitions
This Privacy Policy uses the terminology of the GDPR. It should be legible and understandable for the general public, as well as our customers and business partners. We use the following terms:
- Personal data: any information relating to an identified or identifiable natural person (the "data subject").
- Data subject: any identified or identifiable natural person whose personal data is processed.
- Processing: any operation performed on personal data, such as collection, recording, storage, use, disclosure, erasure or destruction.
- Restriction of processing: the marking of stored personal data with the aim of limiting its processing in future.
- Profiling: any automated processing of personal data to evaluate certain personal aspects relating to a natural person.
- Pseudonymisation: processing personal data so it can no longer be attributed to a specific data subject without additional information.
- Controller: the person or body which determines the purposes and means of the processing.
- Processor: a person or body which processes personal data on behalf of the controller.
- Recipient: a person or body to which personal data are disclosed.
- Third party: a person or body other than the data subject, controller, processor and persons authorised to process the data under their direct authority.
- Consent: any freely given, specific, informed and unambiguous indication of the data subject's wishes agreeing to the processing of their personal data.
4. Cookies
This website uses cookies, text files stored on your device via your browser, to provide a more user-friendly service. You can manage your choices at any time via the banner and the cookie preferences link in the footer. The categories of cookies we use are listed in the Cookie Policy below.
5. Collection of general data and information
When you or an automated system call up the website, we collect general data and information that are stored in the server log files. This may include:
- browser types and versions used;
- the operating system of the accessing system;
- the website from which an accessing system reaches us (referrer);
- the sub-pages accessed;
- the date and time of access;
- an Internet protocol (IP) address;
- the Internet service provider of the accessing system;
- other similar data used to defend against attacks on our information-technology systems.
We use this data anonymously for the correct delivery and security of the website, and we draw no conclusions about you from it.
6. Contact via the website
The website lets you reach us quickly by electronic means, including a contact form and email addresses. If you contact us by email or through a contact form, the personal data you transmit (such as name, business name, email, phone number and your message) are stored to handle your request. We do not disclose this data to third parties without a legal basis.
7. Web analytics
With your consent, we measure aggregate website usage with PostHog on its EU Cloud (EU data residency). Analytics here is first-party and minimal: there is no session recording, no advertising network, and no tracking across other websites. We capture no personal data in analytics events (no names, email addresses or message content, only coarse, non-identifying properties). The provider processes your IP address server-side to derive an approximate location (city or country). You can decline analytics in the cookie banner at any time; the provider acts as a processor and is listed in the sub-processor register, see 019 · Compliance.
8. Third-party services
We keep the number of third parties on this website to a minimum and use only processors that handle data on our instructions. For this website:
- PostHog (EU Cloud) provides the web analytics described above, with EU data residency, no session recording, and no personal data in event properties.
- CookieYes provides the cookie-consent banner and stores a record of your consent choices.
- Vercel hosts and delivers this website (content-delivery network) and processes server log data, including IP addresses, for delivery and security.
- Miyon AG backend (app.miyon.ai) receives contact-form submissions so we can respond to your request.
The full, current sub-processor register is available in the DPA and at 019 · Compliance.
9. International data transfers
We keep personal data within the European Economic Area wherever possible. Our analytics (PostHog) and consent records (CookieYes) are processed in the EU/EEA or in a country recognised by an EU adequacy decision. Website hosting is provided by Vercel Inc. (United States). Where personal data such as IP addresses in server logs is processed in the United States, the transfer is safeguarded by the EU-US Data Privacy Framework and/or the EU Standard Contractual Clauses. You may request a copy of the relevant safeguards from our Data Protection Officer.
10. Routine erasure and blocking of personal data
We process and store your personal data only for the period necessary to achieve the purpose of storage, or as required by the laws to which we are subject. When the purpose ceases to apply or a prescribed storage period expires, the personal data are routinely blocked or erased in accordance with the law.
11. Rights of the data subject
- Confirmation: to obtain confirmation as to whether personal data concerning you are being processed.
- Access: to information about your stored personal data, including the purposes, categories, recipients, storage period, the source of the data, and the existence of any automated decision-making.
- Rectification: to have inaccurate personal data corrected without undue delay.
- Erasure ("right to be forgotten"): to have your personal data erased where a legal ground applies and processing is not necessary.
- Restriction of processing and data portability.
- Objection to processing, and the right to withdraw consent at any time.
To exercise any of these rights, contact our Data Protection Officer at dsb@kertos.io or Mathias.Maierhofer@miyon.ai. We respond within 30 days.
12. Right to lodge a complaint
You have the right to lodge a complaint with a competent supervisory authority in the event of a data protection violation, in particular in the Member State of your residence, place of work or the place of the alleged infringement.
13. Legal basis for processing
- Art. 6(1)(a) GDPR, where we obtain your consent for a specific purpose;
- Art. 6(1)(b) GDPR, where processing is necessary to take steps at your request before or during a contract;
- Art. 6(1)(c) GDPR, where we are subject to a legal obligation;
- Art. 6(1)(f) GDPR, where processing is necessary for our legitimate interests.
14. Legitimate interests
Where processing is based on Art. 6(1)(f) GDPR, our legitimate interest is to operate, secure and improve this website and to respond to enquiries from prospective partners and customers.
15. Period for which personal data are stored
The criterion for the storage period is the respective statutory retention period. After it expires, the data are routinely deleted, provided they are no longer necessary to fulfil or initiate a contract or to respond to your request.
16. Automated decision-making
As a responsible company, we do not use automated decision-making or profiling on this website.
